1. Agreement between you and Quitora
This End User License Agreement ("Agreement") is a legal contract between you and Quitora ("we", "us"), governing your use of the Quitora iOS application and related services (the "Licensed Application"). Apple Inc. is not a party to this Agreementand is not responsible for the Licensed Application or its content. By downloading, installing, or using the Licensed Application, you agree to this Agreement. If you don't agree, do not use the Licensed Application.
2. Scope of license
We grant you a non-transferable license to use the Licensed Application on any Apple-branded products that you own or control, as permitted by the Usage Rules in Apple's Media Services Terms and Conditions. This license does not permit you to use the Licensed Application on any device you do not own or control, and you may not distribute or make the Licensed Application available over a network where it could be used by multiple devices at the same time.
3. What Quitora is (and isn't)
Quitora is a recovery companion app that offers honest check-ins, AI-assisted coaching, mini-games, and educational content. Quitora is not a medical device, diagnostic tool, therapist, or substitute for qualified healthcare. Nothing in the Licensed Application — including AI coach messages, weekly summaries, roadmap insights, or suggested exercises — constitutes medical advice, a prescription, or a diagnosis. If you are in crisis, call 988 (U.S. Suicide & Crisis Lifeline) or your local emergency number. If you have a health condition, consult a qualified clinician before reducing or discontinuing any substance.
4. AI-generated content
The Licensed Application uses third-party large language models to generate coach responses, summaries, and other content. AI output can be inaccurate, incomplete, or misleading. Do not rely on it as professional advice.
5. Subscriptions and payments
Quitora offers auto-renewing premium subscriptions (Monthly at $19.99 USD with a 7-day free trial, 6-Month at $49.99 USD, Yearly at $99.99 USD — prices may vary by region). Subscriptions renew automatically at the end of each billing period at the then-current price unless cancelled at least 24 hours before the period ends. Billing, renewal, and refunds are handled by Apple through your Apple ID. You can manage or cancel anytime in Settings → Apple ID → Subscriptions on your device. Unused portions of a free trial are forfeited when you purchase a subscription where applicable.
6. Eligibility
You must be at least 13 years old (or 16 in the EU and UK) to use the Licensed Application. By using it, you represent that you meet this minimum age.
7. Acceptable use
You agree not to use the Licensed Application to harass others, post illegal content, reverse-engineer the application, scrape or resell its content, or misuse AI features to generate harmful or prohibited output.
8. Maintenance and support
Quitora is solely responsible for providing any maintenance and support for the Licensed Application. Apple has no obligation whatsoever to furnish any maintenance or support services.
9. Warranty
Quitora is solely responsible for any product warranties, whether express or implied by law, to the extent not effectively disclaimed. In the event of any failure of the Licensed Application to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price for the Licensed Application to you (where applicable). To the maximum extent permitted by applicable law, Apple will have no other warranty obligation whatsoever with respect to the Licensed Application, and any other claims, losses, liabilities, damages, costs, or expenses attributable to any failure to conform to any warranty will be Quitora's sole responsibility.
10. Product claims
Quitora, not Apple, is responsible for addressing any claims relating to the Licensed Application or your possession and/or use of it, including: (a) product liability claims; (b) any claim that the Licensed Application fails to conform to any applicable legal or regulatory requirement; and (c) claims arising under consumer protection, privacy, or similar legislation.
11. Intellectual property
In the event of any third-party claim that the Licensed Application or your possession and use of the Licensed Application infringes that third party's intellectual property rights, Quitora, not Apple, will be solely responsible for the investigation, defense, settlement, and discharge of any such intellectual property infringement claim.
12. Legal compliance
You represent and warrant that (a) you are not located in a country subject to a U.S. Government embargo or that has been designated by the U.S. Government as a "terrorist-supporting" country; and (b) you are not listed on any U.S. Government list of prohibited or restricted parties.
13. Third-party terms
You must comply with applicable third-party terms of agreement when using the Licensed Application (e.g., wireless data service agreements with your carrier).
14. Third-party beneficiary
You acknowledge and agree that Apple, and Apple's subsidiaries, are third-party beneficiaries of this Agreement, and that, upon your acceptance of the terms and conditions of this Agreement, Apple will have the right (and will be deemed to have accepted the right) to enforce this Agreement against you as a third-party beneficiary thereof.
15. Disclaimers and limitation of liability
The Licensed Application is provided "AS IS" without warranties of any kind, to the maximum extent permitted by applicable law. To the maximum extent permitted by applicable law, Quitora's total aggregate liability for any claim arising from or related to this Agreement or the Licensed Application will not exceed the greater of (a) the amount you paid to Quitora in the twelve months before the event giving rise to the claim, and (b) USD 50. Some jurisdictions do not allow certain liability limitations; if you reside in one, the sections that conflict with local law do not apply to you and the rest still do.
